ORDINANCE NO. 1031

AN ORDINANCE AMENDING SECTION 503.5 OF THE ZONING ORDINANCE OF THE VILLAGE OF TUSCARAWAS


WHEREAS, Members of Council of the Village of Tuscarawas have been informed that the Tuscarawas Planning Commission has determined that Section 503.5, which deals with accessory buildings or accessory structures, needs to be amended; and

WHEREAS, Members of Council of the Village of Tuscarawas, after consideration and discussion, are of the opinion that such determination of the Tuscarawas Planning Commission is well founded.

NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF TUSCARAWAS, OHIO that:

SECTION 1.

The Zoning Ordinance of the Village of Tuscarawas, Ohio shall be modified/amended as follows:

Section 503.5 shall be amended as follows:

An accessory building or accessory structure shall be located only in a rear yard. However, an unattached garage may be built in a side yard of a single family dwelling under the following conditions:

a. The unattached garage will meet the front, rear and side setback requirements, and maximum height requirements, as applicable to dwellings in Article 5, Section 500.

b. The unattached garage will be compatible with the dwelling in terms of architectural style, roofing materials and color, and siding materials and color.

c. The appearance and location of the unattached garage will not alter the essential character of the neighborhood or district in which the property is located, nor substantially or permanently impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare.

d. An application for a Zoning Certificate to build an unattached garage in a side yard shall include a narrative and building plans/drawings sufficient to allow the Zoning Inspector to determine compliance with the conditions in the above paragraph.

 

SECTION 2.

This Ordinance shall become effective at the first time permitted by Ohio law.
