ORDINANCE NO. 1059
AN ORDINANCE REGULATING THE KEEPING OF ANIMALS ON PROPERTIES LOCATED WITH THE TERRITORIAL LIMITS OF THE VILLAGE OF TUSCARAWAS, THERBY REPEALING ORDINANCE NO. 432
WHEREAS, Members of Council of the Village of Tuscarawas have had recent discussions about the need to more effectively regulate the keeping of animals on properties located within the Village; and
WHEREAS, Members of Council of the Village of Tuscarawas have determined that the existing rules and regulations of the Village, specifically Ordinance No. 432, are not sufficient to address the problem that has been created in the Village by the keeping of certain animals on properties located within the territorial limits of the Village.
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF TUSCARAWAS, OHIO as follows:
SECTION 1.
No person shall keep any pig, horse, cow, goat or any other animal or animals or any fowl or poultry (with the exception of domesticated chickens, which such issue is addressed in separate Village Ordinance, rabbits and turkeys) in any pen, yard, lot or other enclosure situated within the territorial limits of the Village.
SECTION 2.
Any prior Ordinance or section thereof pertaining to the subject treated in this Ordinance, specifically Ordinance No. 432, shall be deemed repealed from and after the effective date of this Ordinance.
SECTION 3.
Due to the past usage of the real estate identified as Parcel Number 66-00524.000, more commonly known as 566 School Street, Tuscarawas, Ohio, such real estate is exempt from the restrictions of this Ordinance.
SECTION 4.
Whoever violates any provision of this Ordinance is guilty of a minor misdemeanor. Each day the violation exists constitutes a separate violation.
SECTION 5.
This ordinance shall be in effect at the earliest time permitted by law.
