ORDINANCE NO. 2025- 03
AN ORDINANCE REGULATING TRAFFIC AT CERTAIN INTERSECTIONS WITHIN THE VILLAGE OF TUSCARAWAS
WHEREAS, the Village of Tuscarawas recognizes the need to protect the safety and welfare of its residents by passing an ordinance regulating traffic at the intersection of Schumacher Drive and Donehue Lane in the Village; and
WHEREAS, the Village Council agrees that the interest of the community will be best served by passing said ordinance; and
THEREFORE, BE IT ORDAINED by the Council of the Village of Tuscarawas, as follows;
SECTION 1.
The Village of Tuscarawas shall erect and maintain properly marked and visible stop signs, compliant with all Federal, State and Local Regulations, at the following intersection: Schumacher Drive and Donehue Lane, facing east and west directions of travel.
SECTION 2(a).
No pedestrian, driver of a vehicle, or operator of a streetcar or trackless trolley shall disobey the instructions of any stop sign placed in accordance with this Ordinance, unless at the time otherwise directed by a police officer.
2(b).
Said pedestrians, drivers or operators who approach an intersection where traffic is controlled by a stop sign shall:
(1) Stop at the clearly marked stop line, but if none, stop before entering the crosswalk on the near side of the intersection, or, if none, stop before entering the intersection;
(2) Yield the right-of-way to all vehicles, streetcars or trackless trolleys in the intersection or approaching on an intersecting road, if the vehicles, streetcars, or trackless trolleys will constitute an immediate hazard during the time the driver is moving across or within the intersection or junction of roadways;
(3) Exercise ordinary care while proceeding through the intersection.
SECTION 3.
This Ordinance is passed with the authority of Ohio Revised Code ยง4511.07(A).
SECTION 4.
Whoever violates this Ordinance is guilty of a minor misdemeanor. If the offender commits the offense while distracted and the distracting activity is a contributing factor to the commission of the offense, the offender is subject to the additional fine established under section 4511.991 of the Revised Code.
No provision of this Ordinance for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person.
SECTION 5.
This Ordinance shall go into full force and effect on the date of its passage.
