ORDINANCE NO. 2025-22
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE TUSCARAWAS COUNTY PUBLIC DEFENDER'S OFFICE FOR YEAR 2026
WHEREAS, the Village of Tuscarawas recognizes its responsibility to provide legal counsel to indigent persons charged with a violation of a Village ordinance for which the penalty or any possible adjudication includes potential loss of liberty; and
WHEREAS, the Village Council agrees that the interest of the community will be best served by authorizing the Mayor to enter into an agreement with the Tuscarawas County Public Defender's Office to provide said legal counsel; and
THEREFORE, BE IT ORDAINED by the Council of the Village of Tuscarawas, as follows;
SECTION 1.
The Mayor of the Village of Tuscarawas is authorized to enter into the attached 'Agreement for Indigent Defense Services in the Tuscarawas County Court' with the Tuscarawas County Public Defender's Office for the term of January 1, 2026 to December 31, 2026.
SECTION 2.
It is found and determined that all actions of this Council relating to the adoption of this Ordinance were conducted in an open meeting of the Council and that all deliberations of this Council and any of its committees that resulted in such formal actions took place in meetings open to the public, in compliance with all legal requirements, including Ohio Revised Code Section 121.22.
SECTION 3.
This Ordinance is hereby declared to be an emergency measure, immediately necessary for the preservation of the public peace, health and safety of the residents of the Village of Tuscarawas, Ohio, and hereby shall take effect immediately after its passage.
