ORDINANCE NO. 2023-31

AN ORDINANCE REGULATING TRAFFIC ON CENTER STREET AND MILL STREET WITHIN THE VILLAGE OF TUSCARAWAS AND DECLARING AN EMERGENCY


WHEREAS, the Village of Tuscarawas recognizes the need to protect the safety and welfare of its residents and students of Indian Valley Middle School by passing an ordinance regulating traffic in the surrounding school area within the Village; and

WHEREAS, the Village Council agrees that the interest of the community will be best served by passing said ordinance which will fully repeal and replace Ordinance No. 744 dated August 14, 2008; and

WHEREAS, this emergency measure is necessary to protect the health, safety and welfare of the community.

THEREFORE, BE IT ORDAINED by the Council of the Village of Tuscarawas, as follows;

SECTION 1.

During the school year between the hours of 7:00 a.m. and 4:00 p.m., excluding school transportation and residents, it is hereby unlawful for a motor vehicle, vehicle, trackless trolley, or streetcar to travel:

(a) on Center Street between Mill Street and School Street when Road Closed signage is in place;

(b) on Mill Street between Center Street and Lincoln Avenue N.E. when barrier arms are in place;

 

SECTION 2.

Daily placement, removal and/or activation of Road Closed signage and barrier arms will be the responsibility of Indian Valley School Officials and at the discretion of the School Officials and/or the Village of Tuscarawas as determined to be necessary for safety purposes.

 

SECTION 3.

This Ordinance is passed with the authority of Ohio Revised Code $4511.07(A).

 

SECTION 4.

Whoever violates this Ordinance is guilty of a minor misdemeanor.

 

SECTION 5.

This Ordinance is deemed to be an emergency measure to protect the health, safety and welfare of the residents of the Village of Tuscarawas, Ohio, and shall go into full force and effect on the first day after its passage by Council as an emergency measure.
