ORDINANCE NO. 2023-32
AN ORDINANCE AMENDING SECTION 24 OF THE VILLAGE OF TUSCARAWAS WATER AND SEWER REGULATIONS AND THE VILLAGE ADVERTISEMENT FOR PROPOSAL FOR INSTALLATION OF WATER AND SEWER TAPS AND DECLARING AN EMERGENCY
WHEREAS, the Village of Tuscarawas recognizes the need to clarify Section 24 of its Water for and Sewer Regulations and to reflect that clarification in its Advertisement for Proposal Installation of Water and Sewer Taps; and
WHEREAS, the Village Council agrees that the interest of the community will be best served by amending its previously adopted Water and Sewer Regulations Section 24 Contractor Specifications for Water/Watestewater Work and the Village Advertisement for Proposal for Installation of Water and Sewer Taps; and
WHEREAS, this measure is necessary to protect the health, safety and welfare of the community.
THEREFORE, BE IT ORDAINED by the Council of the Village of Tuscarawas, as follows;
SECTION 1.
This Ordinance amends prior legislation of the Village of Tuscarawas as to water and sewer fees and regulations, Section 24 Contractor Specifications for Water/Wastewater Work, and its Advertisement for Proposal for Installation of Water and Sewer Taps.
SECTION 2.
Section 24 is amended as follows (changes are bolded and italicized):
SECTION 24. CONTRACTOR SPECIFICATIONS FOR WATER/ WASTEWATER WORK
a. The Village requirements for contractor services for water and wastewater are as follows:
1. Shall be on twenty-four (24) hour call for water main breaks, service line repairs, sewer line and lateral installation and repairs;
2. Shall be responsible for all water and sewer taps within the system of the Village of Tuscarawas;
3. Shall be able to trench, bore, create water and sewer taps, camera and crib open ditch for service work, installations and repairs;
4. Shall be responsible for and provide all safety equipment and services, including the use of trench boxes, cribbing, traffic control, etc.;
5. Shall have experience with and ability to use ductal iron, HDPE, ะก-900, copper service lines, curb boxes, curb and corp stops;
6. Shall be licensed, independently insured and bonded for such projects.
SECTION 3.
The Village Advertisement for Proposal for Installation of Water and Sewer Taps is amended to reflect the language clarified in Section 24(a)(2), which is attached hereto and incorporated herein.
SECTION 4.
It is found and determined that all actions of this Council relating to the adoption of this Ordinance were adopted in an open meeting of the Council and that all deliberations of this Council and any of its committees that resulted in such formal actions took place in meetings open to the public, in compliance with all legal requirements, including Ohio Revised Code Section 121.22.
SECTION 5.
This Ordinance is deemed to be an emergency measure to protect the health, safety and welfare of the residents of the Village of Tuscarawas, Ohio, and shall go into full force and effect on the first day after its passage by Council as an emergency measure.
